Smith is being sued for $2.5 million by a man he got into a dispute with outside of New York nightclub 1OAK back in November. The suit was filed Thursday. The plaintiff, Justin Brown, claims Smith turned down a request for a photo. The police report claims that Brown then said, “That’s why you got kicked out of New York,” which is when Smith allegedly choked and hit him in the neck and head.
ESPN reports there is video of the incident, but it appears not to have been released yet.
After Sunday’s game in which the Cavaliers beat the Knicks 107-93, Smith was asked about the altercation and responded, “No, I ain’t got no comment on that. It is what it is. So, we’ll just see what happens.”
Smith said he appreciated how much the Cavaliers’ front office has supported him throughout the whole situation.
“I mean, the organization has been great since I got here,” he said. “Whether it was that or anything else, they’ve been unbelievable, so I’m grateful for that.”
Smith’s lawyer said the lawsuit holds no merit and is nothing more than a cash grab.
